Purchases, Sales, Leases, Easements and Other Real Estate Agreements

To initiate the process of obtaining a license, lease, easement, or purchasing Amtrak-owned property, an applicant must submit an application to the Third Party Property Access (TPPA) portal. To ensure timely processing of the application, the applicant is strongly encouraged to answer all application questions and provide supplementary project information, including but not limited to, the general location map, site map, aerial image, project summary and any other attachments. All applications will be subject to a non-refundable application fee.

Upon receiving these materials, the Real Estate team coordinates with multiple departments to review the request. The approval review process takes several months; a full and detailed submission of the application, relevant information and associated fees is a key step to ensure timely processing. An application for real estate rights does not guarantee approval.

If the applicant’s intended use includes improvements, then the applicant must also submit engineering design review and construction applications. If approved, the applicant will be required to reimburse the railroad for the cost of design and construction fees, pursuant to separate engineering agreements.

If your use and design are approved, a real estate agreement will be forwarded to the applicant for signature. The agreement on an Amtrak-approved form will outline the terms and conditions of the occupancy as well as any insurance requirements. In the event there will be construction activity related to the occupancy, Railroad Protective Insurance will also be required.
